Terms of Use for ParkinganPH

1. Agreement to Terms

By downloading, accessing, or using the ParkinganPH mobile application ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

ParkinganPH is a mobile application that provides information about the location and details of parking spaces in the Philippines. The information is provided for informational purposes only.

3. Use of the Service

You agree to use the Service only for lawful purposes. You agree not to:

  • Reverse-engineer, decompile, or otherwise attempt to discover the source code of the application.
  • Use any automated system, including "bots" or "spiders," to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.
  • Use the Service in any way that could damage, disable, or impair it.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ParkinganPH. Our trademarks and branding may not be used in connection with any product or service without our prior written consent.

5. Third-Party Services

The Service utilizes the Google Maps Platform. By using our Service, you are also bound by the Google Maps/Google Earth Additional Terms of Service.

6. Disclaimers and Limitation of Liability

This is a critical section. Please read it carefully.

  • "AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
  • NO WARRANTY OF ACCURACY: ParkinganPH makes no warranty or representation regarding the accuracy, timeliness, or completeness of the information provided within the Service. Parking information, including availability, pricing, hours of operation, and rules, is subject to change without notice and may be inaccurate or outdated. We rely on publicly available data and do not have direct partnerships with the parking lot operators at this stage.
  • NO LIABILITY FOR DAMAGES: To the fullest extent permitted by law, ParkinganPH and its founder shall not be liable for any direct, indirect, incidental, or consequential damages. This includes, but is not limited to, damages resulting from:
    • Any parking tickets, fines, or penalties you may receive.
    • Your vehicle being towed, booted, or damaged.
    • Theft of your vehicle or its contents.
    • Personal injury occurring at any parking facility.
    • Reliance on any information provided by the Service.

You agree that your use of the Service and any reliance on its information is solely at your own risk.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of changes within the application.
